1. About These Terms
These Terms of Service ("Terms") govern your use of MountainShield ("Service"), operated by MountainShield, Inc. ("we," "us," "our"), a Delaware corporation. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Nature of Service — Advisory Only
MountainShield provides advisory cybersecurity guidance. Our service consists of analyzing submitted content (links, messages, files) and providing an assessment of risk indicators along with recommended next steps.
The Service is not a security guarantee, insurance product, legal service, or emergency response service. All assessments are based on available indicators at the time of review and reflect our analysts' professional judgment. We do not guarantee any specific outcome or protection against harm.
3. No Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ASSESSMENTS WILL BE ACCURATE OR COMPLETE.
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL FEES YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.
Note: Some jurisdictions, including EU member states, do not allow certain liability exclusions. In those cases, the above limitations apply to the maximum extent permitted by applicable law.
5. User Responsibilities
By using the Service, you agree to:
- Provide accurate context when submitting checks
- Not share your passwords, PINs, or account credentials with us — we will never ask for them
- Not use the Service to request guidance on illegal activities
- Not submit content that you do not have the right to share
- Not attempt to reverse-engineer or probe our systems
- Comply with all applicable laws in your jurisdiction
6. Remote Assistance — Premium Only
Premium plan subscribers may access guided remote assistance sessions for incident response. Remote assistance requires:
- Your explicit written consent before each session
- A defined and agreed scope limited to the specific incident
- Your right to terminate the session at any time without explanation
Remote access is only provided through our official, verified support channel. We will never initiate unsolicited remote access requests. If you receive such a request, it is not from us.
7. Fair Use and Acceptable Use
"Unlimited checks" on Standard and Premium plans is subject to fair use. We reserve the right to contact users whose usage volume significantly exceeds typical personal use patterns. The Service may not be used to:
- Conduct offensive security operations or hacking against others
- Harass, stalk, or surveil individuals
- Conduct illegal OSINT or privacy violations
- Automate or scrape our Service
- Resell or redistribute our assessments without permission
8. Payment and Subscription
Subscriptions are billed monthly. By providing payment information, you authorize us to charge your payment method on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days' notice.
9. Termination and Refunds
You may cancel your subscription at any time. We may suspend or terminate accounts that violate these Terms. In cases of termination for cause, no refund is due. In other circumstances, we will consider refund requests for the current billing period on a case-by-case basis. To request a refund, contact support within 14 days of the charge.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. EU consumers retain rights under applicable EU consumer protection law, which may supplement or supersede certain provisions.
11. Dispute Resolution
We prefer to resolve disputes informally. Please contact us first at support@mountainshield.example before initiating any formal proceeding. If informal resolution fails, disputes shall be resolved by binding arbitration under applicable rules, on an individual basis, except that either party may bring claims in small claims court.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you by email or by posting a notice on our website at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance.
